Payout Tiers and Compensation Options
The $177 million fund is split into a $149 million fund for the first breach and a $28 million fund for the second breach. Payouts are categorized into three distinct tiers based on the type of data exposed and financial harm.
- Documented Loss Payouts: You can claim up to $5,000 for the first breach and $2,500 for the second if you have proof of out-of-pocket losses. These losses must be traceable to the breaches and can include costs like identity theft protection services or unauthorized bank charges.
- Tier 1 (SSN Exposed): Class 1 members whose Social Security numbers were leaked will receive a cash payment estimated to be five times larger than Tier 2 payments.
- Tier 2 (General PII Exposed): Class 1 members whose personal information was leaked, but not their Social Security numbers, will receive a standard base payment.
- Tier 3 (Call Records Exposed): Class 2 members who were affected by the July metadata breach but did not suffer documented financial losses will share the remaining $28 million fund on a pro-rata basis.
