TreeHouse Foods has agreed to a $4 million settlement to resolve a class action lawsuit following the voluntary recall of over 600 frozen breakfast products in October 2024. The litigation alleged that TreeHouse acted negligently by failing to warn consumers that its frozen waffles and pancakes were potentially contaminated with Listeria monocytogenes, a dangerous bacterium that can cause severe infections. Although TreeHouse denies all charges of wrongdoing, the settlement aims to reimburse consumers for economic losses incurred when they were forced to discard potentially contaminated food.

Eligibility and Brands Covered

The "Settlement Class" includes all natural persons who purchased a "Covered Product" in the U.S. for personal or household use.

  • Qualifying Dates: You must have purchased the products between October 18, 2024, and September 2, 2025.
  • Brand List: Over four dozen brands are covered, including Great Value (Walmart), Good & Gather (Target), Kodiak Cakes, Clover Valley, Best Choice, and Breakfast Best.
  • Residency: Only residents of the United States are eligible to participate in this specific $4 million fund.

Compensation Tiers and Payout Amounts

The settlement provides two paths for reimbursement depending on your available records.

  • Documented Claims: If you submit a valid receipt or store loyalty card record showing the purchase price, you are eligible for a full refund, including taxes, for every unit purchased.
  • Undocumented Claims: If you do not have receipts, you can still claim the average retail price for up to two units per household.
  • Maximum Award: While there is no fixed cap for documented claims, the administrator may scale payments pro rata, with an estimated maximum of $50 per person if funds are limited.
  • Deductions: If you already received a direct refund or reimbursement from TreeHouse Foods at the time of the recall, that amount will be subtracted from your settlement payout.

Required Action Steps to Secure a Refund

You must take proactive steps to claim your share of the $4 million fund before the window closes.

  1. Review the Product List: Visit WaffleRecallSettlement.com to confirm if your specific brand and lot code are included in the recall.
  2. Submit the Online Form: Complete each field regarding your contact info, purchase location, and payment preference (Venmo, Zelle, or paper check).
  3. Attach Proof: Upload itemized retail sales receipts or photos of packaging if you are claiming more than two items.
  4. Mail Option: You may alternatively download, print, and mail a physical claim form to the administrator in Philadelphia.
  5. Final Deadline: All claims must be submitted online or postmarked by December 16, 2025.

Case Status and Timeline

The court granted preliminary approval on September 2, 2025.

  • December 12, 2025: A status conference was held to set the date for the Final Approval Hearing.
  • Distribution: Once final approval is granted and any subsequent legal appeals are resolved, payments will be sent to approved claimants.
  • Rights Forfeiture: If you do nothing, you will not receive a payment and you will forfeit your right to sue TreeHouse Foods individually for these claims in the future.
